Model Releases

A model release is a legal document signed by a person depicted in a photograph, granting permission to the photographer or photo buyer for publishing the photograph in one form or another. For stock photography, a model release is a requirement when using images for commercial use. No release is required for publication as news or human interest stories. These are called Editorial photos. In general, no release is required for a photo taken of an identifiable person when the person is in a public space, unless the use is for commercial purposes, promoting a product, service or idea.

Model Releases: A model release must be submitted for any commercial content that features a recognizable individual(s). Additionally, if the person might 
be recognizable (due to accessories, clothing, etc.), then a model release should be obtained.

Property Release: A property release must be submitted for any commercial content that is shot on private property, or is taken on public property but features distinctive private property.

Why are model releases important?

Model releases help protect both the photographer and customer from any claims that may be brought by the model due to the use of the model’s likeness. By obtaining a model release, the photographer is given the right to use the model’s likeness under the conditions laid out in the release.

Minors

Please note that model releases for minors (individuals under 18 years of age) require the consent of a parent or guardian of the minor. Please submit a Minor Model Release for content featuring minors.

Nudes

Pictures of adult nude models must, of course, have a model release, but also a picture ID with proof that the model is at least 21.

Remember, a properly signed model release is essential when posting photos of individuals.

2. Property Releases

Why are property releases important?

Private property may be subject to certain protections. Legal considerations related to private property vary by jurisdiction, but some considerations include claims of trespass, orders of a congress or administrative agency, proprietary rights 
to designs on the property, or restrictions against shooting content upon admission.

A property release signifies that the owner or authorized representative of the property has given you permission to use images or footage taken on the property for commercial use.
